Court upholds Ssematimba as Busiro South MP

The Court of Appeal has upheld the election of Peter Ssematimba as Busiro South Member of Parliament in the 2016 general elections.

Steven Ssekigozi who was the runner up took to court challenging the election prompting Justice Lydia Mugambe to nullify his election and ordered for fresh elections.

Ssematimba, however, appealed against the High Court decision to nullify his election.

The court of appeal on Monday declared him the rightfully elected MP for Busiro South.

Ssematimba’s lawyers

“He who makes allegations must prove them,” said registrar Deo Nzeyimana in ruling.

The ruling also faulted High Court for not accepting Ssematimba’s academic documents presented as evidence saying it was wrong.

“The appeal succeeds and the first appellant was lawfully elected Member of Parliament for Busiro South.”

The court has ordered Ssekigozi to pay costs arising out of the Appellant court and High Court.
